The Bharatiya Sakshya Adhiniyam (BSA), 2023 establishes the general rules and principles of evidence required for fair trials. It replaced the Indian Evidence Act, 1872.
The BSA was enacted on 25 December 2023 and came into force on 1 July 2024. Its stated purpose is to consolidate and provide general rules and principles of evidence for a fair trial.
Why Is Evidence Important?
A legal case cannot ordinarily be decided merely on allegations. Courts examine facts and evidence presented according to law.
Evidence may include:
- Oral testimony
- Documents
- Official records
- Photographs
- Videos
- Electronic records
- Digital communications
- Expert opinions
- Other legally relevant material
The BSA provides rules concerning relevance, proof, admissibility, witnesses and examination of evidence.
Electronic and Digital Evidence
One important aspect of the modern evidence framework is the treatment of electronic and digital records.
The BSA contains specific provisions dealing with electronic or digital records and their admissibility, including provisions relating to electronic records, electronic signatures and presumptions concerning certain electronic records.
This is particularly relevant in cases involving:
- WhatsApp or other digital messages
- Emails
- CCTV footage
- Digital photographs
- Audio/video recordings
- Online transactions
- Computer records
- Electronic documents
- Other digital communications
Why Is This Important for Citizens?
People often possess potentially important information but do not preserve it properly.
For example, deleting messages, modifying photographs or altering digital files may affect their evidentiary usefulness.
Therefore, where a person is involved in a legal matter, relevant records should be preserved in their original form as far as possible.
Burden of Proof
The BSA also contains provisions relating to the burden of proof, including provisions identifying who must prove particular facts in different circumstances.
The burden of proof is a legal concept and should not be confused with simply making an allegation.
How Can Citizens Benefit?
Legal awareness regarding evidence helps citizens:
- Preserve important records.
- Understand the importance of witnesses.
- Avoid destroying or manipulating evidence.
- Understand why documents and digital records matter.
- Present information to competent authorities in an organised manner.
Key Awareness Point
BSA answers the question: “What evidence is relevant, how is it proved, and how can a court consider it?”
